They accuse him of not complying with the necessary interval time so that he can be reelected. The official presentation of the lists expires this Thursday at 4:00 p.m.
Hours before the deadline for the officialization of lists of judges in the electoral board of the Association of Magistrates expires, in what will be the renewal within the Council of the Judiciary, one of the opposition candidates, Eduardo Machinpresented a formal recusal to the applicant of the ruling party, Alberto Lugones. She accuses him of failing to meet the required interval time so that he can be reelected.
The elections will be next October 18but the formal presentation of the lists expires this Thursday at 4:00 p.m. a legal battle began with an uncertain end.
Among the lists there is a proposal linked to the ruling party, another to the opposition and a more “professionalist” one, somewhat further from the political agenda. Both judges and lawyers must elect four representatives, of which two must be women, in accordance with the commitments that the Council was assuming in terms of gender equality.
In this context, the candidate for Judicial Commitment, the Commercial chamberlain Eduardo Machín, presented an amparo against the candidacy of Lugones, who heads the Celeste List, which groups the magistrates closest to the Government.
“Dr. Lugones intends to be reelected in office, something that in our opinion it is forbidden“, the letter begins. According to it, the members of the Council of the Judiciary last four years in their positions, being able to be re-elected with interval of one periodsomething that is provided for in law 24,937.
“The wording of said norm leaves no room for doubt that, in order to be re-elected once a term has been fully completed, there must be an interval of a period which would not be happening in the species“, Complete on the protection. Now it will be the Electoral Board of the Association of Magistrates and Officials of the National Justice that will have to make a determination in this regard.
What has been speculated up to now is that the Frente de Todos, which is promoting an aggressive strategy to control the Judicial Council, I would add one or two advisers among the lawyers and legislatorsregarding the current composition, to the detriment of Together for Change.
It is that the ruling party managed to present two lists of lawyers -of the three that are presented for elections-, with which they will probably keep two representatives, even if they came in second and third place in the elections on October 18.
“There was a fourth independent list that was going to be presented, headed by former counselor Alejandro Fargosi, with a strong anti-Kirchnerist speech. But they asked for 1,000 endorsements to be able to present themselves. Only those who have a strong party apparatus behind can achieve that,” he explained to Clarion a source of lawyers.
In this way, Together for Change, which now has three representatives among the lawyers - of the four sent by that body - would resign a delegate, who would go to the labor lawyer Héctor Recalde, former member of the Judicial Council and former head of the bloc of Kirchnerist deputies, father of the current Camporista councilor Mariano Recalde.
