Maharashtra: Hiding from wife about being gay, life ruined, court did not grant anticipatory bail

A court in Thane district of Maharashtra has rejected the anticipatory bail plea of ​​a 32-year-old man from Navi Mumbai who allegedly cheated on him by hiding from his wife that he was gay. The man is also accused of forcing one of his homosexual partners to go on a honeymoon with himself and his wife. Additional Sessions Judge RS Gupta rejected the bail plea on Tuesday and a copy of the order was made available on Friday. The accused and the complainant (30) had met each other through a social media platform and both were married in November 2021.

The woman lodged a complaint with the police that after marriage she came to know that her husband is gay and came to know from her private WhatsApp messages and some videos in her mobile that she was having sex with two men from Mumbai. The woman said in her complaint that when she questioned her husband about this, he intimidated her with a knife.

The complainant’s lawyer Sagar Kadam told the court that in order to impress her before their marriage, the accused showed her a fake job letter stating that her salary was Rs 14 lakh per annum. Kadam and prosecutor VA Kulkarni submitted that the accused, before marriage, concealed the fact that he was homosexual and thus cheated the complainant and ruined his life.

The investigating officer said that the phone conversation (chat) between the accused and his other male accomplices clearly indicates that he is interested in having sex with people of the same sex. The defense counsel opposed the prosecution saying the allegations were aimed at defaming and harassing him and sought relief.

Dismissing the anticipatory bail plea of ​​the accused, the judge observed, “Prima facie it appears that the accused intended to cheat, did wrong by causing financial loss to the parents of the complainant and causing irreparable damage to the life of the complainant and commit fraud.”
