Haryana Chief Minister Nayab Singh Saini is entitled to full salary as Chief Minister even without being elected as an MLA. Assembly Member Salary Act will not apply to him for receiving salary as Chief Minister. Not only this, Naib Singh Saini will also be able to receive salary and allowances as an MP till the completion of the tenure of the current 17th Lok Sabha. Recently, the BJP leadership had handed over the responsibility of Chief Minister to Naib Singh Saini while he was an MP. Former Chief Minister Manohar Lal has resigned and vacated the Karnal assembly seat for him, for which by-election will be held on May 25 and Saini will contest the assembly elections from here. During this period, as Chief Minister, Naib Singh Saini will get allowances along with salary. It is a different matter that they will not be able to get constituency allowance and telephone allowance.

Advocate Hemant Kumar of Punjab and Haryana High Court says that in Haryana, if someone holds the post of Chief Minister or Minister without being elected as an MLA, then constitutionally it is necessary to get elected as a member of the State Assembly within a period of 6 months, but as far as such As far as facilities like salary and allowances available to a non-MLA Chief Minister or Minister are concerned, he will get the same.

He told that the Chief Minister will receive hospitality allowance even before becoming an MLA. Apart from this, there is also a provision to provide them with government accommodation or fixed allowance in lieu thereof, government vehicle or conveyance allowance in lieu thereof and allowance for office expenses in the constituency. Income tax on both the salary and allowances received by every Chief Minister and every Minister will also be paid from the state treasury. Since Chief Minister Nayab Singh is not currently a member of the 14th Haryana Legislative Assembly, he will not receive constituency allowance allowance and office expenses in the constituency. If he is elected MLA by winning the by-election on the assembly seat scheduled on May 25, then he will start getting the said election allowance and office expenses.
